CAUCUS INVOCATION: Thank God we live in a country free of oppression?

This just past Saturday (3/10/2012) this author attended the Wright County MN BPU Convention in Buffalo Minnesota. (In a previous article, this author exhorted: Why you must attend your Caucus this year! http://bit.ly/AyRuGR aka walking the walk)

Among the items of business on the Agenda was an Invocation at about 9:30am.

As the author listened to the invocation, I heard words to this effect:

“Thank God we live in a country free of oppression.”

And this author found himself taking exception to this statement. It is not this author’s life experience that citizens of this country are free of oppression, suppression nor repression.

As the meeting continued, this author thought to himself, seeking just to go along to get along, perhaps the person giving the invocation has not been exposed to the oppression, suppression and repression that is America.

Perhaps the person who gave the invocation was merely thinking about the recent violence in Syria, Egypt, Libya and the long running oppression in North Korea.  Or even China’s Tiananmen Square Tragic expression of Tyranny…

Trying to give the benefit of the doubt, the author postulated that perhaps the person who gave the invocation, was not familiar with the various kinds of oppression, suppression and repression.

But as hard as this author tried to let the statement go, something kept clawing at him to not let this misstatement stand unchallenged.

And so, in the early afternoon, this author privately asked the chair of the convention for 5 minutes as a point of personal privilege (Look it up in Robert’s Rules http://bit.ly/yjCYqc ) for 5 minutes to address the misstatement.

This request was summarily denied. The Chair stating that oppression was a matter of opinion. But this author appealed to the parliamentarian who ruled, “A point of personal privilege is always in order”

Before a pause in the proceedings occurred that this author might force the chair and floor to hear my point of personal privilege, the recalcitrant chair announced (to CYA) that the “person who wished to express a point of personal privilege could address the floor”

With that, this author stepped to the nearest mike and did address the floor. However, this author does not think he did the point justice. But given the circumstances, this author did the best he could extemporaneously.
And, therefore, this would like to take this opportunity to put my thoughts on the alleged “lack of oppression in America” to writing. So here goes.

Oppression, Suppression and Repression comes in all forms, shapes and sizes.  Many think of oppression coming at the point of a gun. While that ultimately is true in all circumstances, most suppression in America is presented in such a way so as to not cause WE THE PEOPLE to think our government is bad or evil.  At least not as bad or evil as WE THE PEOPLE think due to the propaganda, media bias and indoctrination regarding Oppression in Countries such as Russia (Stalin’s Purge), China (Tiananmen Square), Iraq (Hussein’s Rape Squads), and the current situation in Syria.

WE THE PEOPLE, the rank and file citizens of America like to believe the fairytales about Oppression that we were indoctrinated with in Public School, and which are later supplemented with by a compliant, duplicitous and corruption enabling major media.

This author remembers how happy, secure in his person and superior he felt in the aftermath of his indoctrination in the public schools.  Superior in the knowledge that our Country’s Government was honest and trustworthy unlike all the other Government in the world, especially the Communists. Happy and Secure in my person that my government, unlike other government in the world, made decisions based on the best interests of its citizens… Ah… ignorance is most assuredly bliss.

In a peremptory attempt to ward of a public lynching, this author again states that our government, is still the best form of government in the world, despite its current issues. But WE THE PEOPLE would be remiss to not weld ourselves to the truth rather than the fiction of what our government is and isn’t.

Our current elected officials have just stopped obeying Natural Law, the Constitution, the Bill of Rights and common sense. And with that peremptory attempt to reduce the possibility of this author’s spontaneous lynching out of the way, here goes:

#CNNDebate Can you hear us now?

After 25 or so Election 2012 Presidential Primary debates, this author looked forward to the #CNNDebate.

After hearing such probing questions as pizza crust preferences and favorites from among Elvis and Johnny Cash, this voter looked for to having an Election 2012 Primary Presidential Debate that finally asked the tough questions. http://huff.to/AxhvKt

CNN raised this author’s expectations when it encouraged viewers to submit there on questions and comments via Twitter.com in advance of the 2/22/2012 debate in Arizona. At last, it seemed we were on the cusp of an enlightening debate.

About this same time social issues like birth control and forcing churches to provide birth control through insurance to their employees surfaced.

And so before the debate, this author tweeted:

Proposed Election 2012 Caucus Resolutions for Judicial Reform (updated & expanded) Part 1of 2

This is a list of proposed 2012 Caucus resolutions for judicial reform. For Rank and File Americans, Party affiliation will not be a concern in endorsing these proposed resolutions. Collectively, these Resolutions call for Judicial TAR reform Legislation. (Transparency, Accountability and Reform)

We encourage you to reprint these and take them to your upcoming caucus and/or District, State and National conventions.

If your caucus has not already been held, please present any and/or all of these proposals that you agree with at your precinct caucus.  (Even if you live in a primary state, there is still a caucus) If you precinct caucuses have already been held, please contact your delegates selected for the District, State and National
Conventions and ask them to submit these resolutions at that level. If you are a delegate to the District, State or Federal Convention for your party, please submit and/or support these resolutions at that level.

Again, this author believes these resolutions to be non-partisan in nature, yet essential to reestablish the role that Natural Law, the Constitution, the Bill of Rights and the Rule of Law in our currently systemically corrupt state and federal judiciaries.


At the same time, some of these proposed resolutions may not apply to your state, depending on the level of corruption that has encroached on justice in your locality. While this author will try to point out resolutions that may not be applicable to states other than Minnesota, please review each resolution for applicability to your state. Again, the progression of judicial corruption in your state may not have reached the systemic corruption in Minnesota, and therefore certain of these judicial reform platform resolutions may not be applicable to your state.

Most of these resolutions are the result of the culmination of the work of hundreds of Minnesota Citizens attempting to exercise our Constitutional 1st Amendment Right to Petition the Government for Redress of grievances for the past 7 or more years.  (The Minnesota State House and Senate Judiciary Committees for 7 years have refused to allow 100’s of Minnesota Citizens a hearing to provide evidence and testimony of corruption in the Minnesota Courts.) This is this author’s “Plan B” to forcing Judicial Reform. Some of the resolutions contain links to the historic or logical explanation for the proposed resolution. If you are so motivated, rally or friends and neighbors (or other delegates at District, State and Federal Conventions) to go to your precinct caucus to press this agenda.  Be prepared to hear at the beginning of District Conventions various motions to limit debate to save time.  (The reality being that the status quo entrenched delegates and the political parties themselves do not want change; they want the status quo. Be prepared for resistance to these resolutions from those who benefit from the current corrupt system.)

PROPOSED RESOLUTION 1

Whereas,

Judicial decisions should be based on the Rule of Law based on the facts in evidence;
Instead, justice in American is more a matter of “How much justice can you afford?” who you know, who you can influence and/or exchange of political favors with, punishment of lawful political dissent, reward for political loyalty and the Whim of Judges. Citizens should be able to come to before the Courts and have a full, fair, impartial and just adjudication of their cases.

THEREFORE, BE IT RESOLVED THAT LANGUAGE SHOULD BE INCORPORATED INTO OUR PARTY PLATFORM TO REFLECT THE FOLLOWING:

1)      Judicial Decisions must be based on Natural Law and the Rule of Law applied to the facts freely admitted in evidence;

PROPOSED RESOLUTION 2

Whereas,

1)      The legal profession was necessary at the beginning of the Country;
2)      But literacy rates have improved such that most high school graduates could represent them selves in most matters if the laws, court rules and case law were written plainly and in simple English;
3)      Lawyers often do not treat their clients ethically and current use the laws and rules to the disadvantage of their own clients;
4)      Lawyers are so expensive as to prohibit many people from hiring one;
5)      Straight forward, simple English laws and court rules compiled and collated in a few documents would allow rank and file Americans to better represent themselves and better understand the process even when they are represented by a lawyer;
6)      The current amalgam of Court rules, Case Law and Legislation are unnecessarily complex and confusing;
7)      The scattered nature of Court Rules and Case Law yields great unnecessary expense to rank and file Americans who have to pay attorneys who say they “research” the legal nuances;
8)      Case Law is full of unresolved conflicting rulings on the same subject;
9)      Case Law Conflicts allow Judges to Cite 1 Case Law Citation in one case and a difference citation in a same/similar but different case with wildly difference outcomes. This defies the intention of the “Rule of Law”.
THEREFORE, BE IT RESOLVED THAT LANGUAGE SHOULD BE INCORPORATED INTO OUR PARTYPLATFORM TO REFLECT THE FOLLOWING:
1)      That the entire legal code, court rules and case law be written in simple English so that Citizens with a high school degree that can represent themselves;
2)      That the Legislature of the State is required to undertake this task immediately and resolve all conflicts in cases law in so doing;
3)      That thereafter, every 10 years, the Legislature will meet to incorporate all interim case law in the code and resolve all conflicting case law rulings;
4)      WE THE PEOPLE propose that all State and Federal Court Rules, Case Law and Legislation be logically laid out in 5 documents:
A)     Federal Criminal Code
B)     Federal Civil Code
C)     State Criminal Code
D)     State Civil Code
E)      State Family Code

PROPOSED RESOLUTION 3


Whereas,

1)      The Natural Law Right to own Property is affirmed by the Constitution and Bill of Rights;
2)      The Condemnation of Private Property (takings) for Public Use as narrowly defined in the Constitution and 5th Amendment has been interpreted in an unconstitutional way by the US Courts;
3)      Essentially the US Courts have ruled that Government can act as kings and take property from one private property owner and give it to another private Property Ruler;
4)      These Court Rulings essentially reestablish our government philosophy as “The Divine Right of Kings;
5)      The Courts have ruled that the Government can condemn one citizens private property and give it to another private citizen or business;
6)      The Courts have ruled that Citizens cannot drink milk from a cow that they own all or party of;
7)      The United Nations Agenda 21 is yet another reassertion of the Divine Right of Kings upon WE THE PEOPLE;
THEREFORE, BE IT RESOLVED THAT LANGUAGE SHOULD BE INCORPORATED INTO OUR PARTY PLATFORM TO REFLECT THE FOLLOWING:
1)      Our State and Federal Legislatures shall pass legislation condemning the property right power grab by the US Courts;
2)      Said Legislation shall restore “Public Use” to it original narrow intent of the Founders.

Pirates of Publicly Funding the Minnesota Vikings Stadium

(In other States this should be titled – Pirates of Public Funding of Professional Sports Stadiums)

Having heard some of the criticism of his position on the public financing of professional sports, this author presents his peremptory qualifications as a football fan.
1)      In Elementary school, when whether permitted recess was roughly evenly divided between school yard foot ball and deer tag;
2)      In Junior High, during summer vacation, this author broke his hip playing sandlot football;
3)      In Senior High, this author played on the High School Football Team;
4)      In College, this author played intramural football;
5)      This author was affiliated with certain undisclosed parties that smuggled kegs into Golden Gopher football games at Memorial Stadium during college;
6)      If the this author had grown up in Minnesota, he would be a Vikings Fan;
7)      If The ViQueens had had a winning team when this author first came from Wisconsin to Minnesota for College, he would now be a Vikings fan instead of remaining a Packer fan.

Having firmly established he is not some prissy poindexter that shares no love of the game and is just acting as a spoiler, we shall continue.

It is almost beyond reasoned belief that this debate of the public financing of a new stadium for the Minnesota Vikings continues.

Last year, in public hearing after public hearing, the WE THE PEOPLE showed up in great numbers and with great enthusiasm and said, “Hell No!” to public financing.  Yet hear we are again in 2012, being bombarded with new angles on how to jam a stadium project that includes jamming public funding down our throats. This TAR Resolution passed my Minnesota Caucus

TRANSPARENCY, ACCOUNTABILITY AND REFORM (TAR)

REQUIRED POSTING OF ALL MUNICIPAL BUDGETS AND ACTUAL SPENDING AND REVENUE TO ON THE INTERNET IN LAYMAN'S TERMS WITH NO AGGREGATES OVER 100 DOLLARS

Whereas, Wright County and other Municipalities refuse to make data that is suppose to be public record available to the public,

Whereas the Legislature has purposely made no provision for citizens to force municipalities to provide said information other than suing the municipality in court using their own money,

Whereas Government auditors are worthless,

Whereas our elected officials can’t seem to find the waste and fraud in government themselves,


THEREFORE, BE IT RESOLVED

that the Republican Platform shall contain a plank requiring all Minnesota Municipalities (Cities, Counties, Schools, Met Council, Airport Commissions, Port Authorities etc) to

POST ALL BUDGETS AND ACTUAL SPENDING AND REVENUE ON THE INTERNET IN LAYMANS TERMS WITH NO AGGREGATES OVER 100 DOLLARS.


Said data to be downloadable to files like excel with no functionality locked out so Citizens can analyze the date themselves.

The fundamental understanding our US Founding Fathers had in drafting our constitution, is People under Natural Law have free will, and are not virtuous by nature. Therefore, governments must be constructed in anticipation of the nature of man. Acting on this knowledge, our Founding Fathers built into our Government and Constitution, various checks and balances.

Amongst these checks and balances were transparency and accountability. All of our problems today emanate from the slow, persistent rolling back of the checks and balances, transparency and accountability our Founding Fathers built into our Government and Constitution.
